The author contends that a gap exists in the understanding of dementia from a social justice perspective and that there is a need to examine dementia using a human rights lens, arguing that it is a disability and therefore people with dementia are entitled to each of the rights in the United Nations' Convention on the Rights of Persons with Disabilities. She explores dementia from a disability perspective; the Convention on the Rights of Persons with Disabilities as an instrument of social change and means to reframe dementia as a disability and human rights issue and way to reform dementia policy and practice; rights that are often restricted for those living with dementia, including the right to be treated equally before the law, the right to a timely diagnosis and its ethical disclosure, the right to rehabilitation based on a multi-disciplinary assessment, and the right to live well with dementia in the community with personal supports; the basic human rights people living in long-term residential care should have that are sometimes denied, such as the right to be protected from degrading treatment or punishment, the right to privacy, and the right to access outdoor areas and participate in cultural, recreational, and leisure activities; the implications of a human rights-based approach for dementia policy and practice; and the concepts of autonomy and capacity as they relate to Article 12 of the Convention on the Rights of Persons with Disabilities and the more recent General Comment on Article 12.
