About this item

This work for legal scholars and students applies feminist judgment, an emerging technique of critical legal scholarship, to 25 significant court judgments in New Zealand’s legal history, from 1914 to 2015. Nineteen of the cases presented are feminist judgments using a feminist analytical framework, while six of the cases are examined using an approach based on ‘mana wahine,’ which is the application of Maori values related to women’s lives. The reimagined judgments are written within the constraints of precedents, legislation, style, and legal and social science research which existed at the time of the original cases. Each judgment is preceded by commentary to provide context and to spotlight the goals and methods of the judgment writer. The book includes three introductory chapters outlining basics of Maori legal thought, the New Zealand legal system, and the evolution of the feminist judgments movement.
